2,181 law firms worldwide practising Real Estate Due Diligence. Narrow down by city to find a firm near you.
Real estate due diligence is the legal check a lawyer carries out before you buy, lend against or lease a property. It covers title and ownership, mortgages and other charges, easements and rights of way, zoning and building permits, existing leases and tenants, unpaid taxes or service charges, environmental issues and pending litigation. The result is a report that tells you what you are really buying and which risks to price in or fix before signing.
The checks depend on national law. Land registries differ in how reliable they are. Some guarantee title, others only record deeds, and some countries have parts of the territory with incomplete records. Notaries carry out part of the work in many civil law systems, but they do not always check permits, leases or planning status. Foreign buyers may need extra checks on whether they are allowed to buy at all.
Fees for due diligence are often fixed for a single home and hourly or budgeted for commercial portfolios. Contingency fees do not fit this kind of advisory work and are not allowed in many countries. Surveyors, environmental consultants and registry search fees come on top.
Time limits come from the deal. Due diligence usually has to be finished before contracts are exchanged or a deposit becomes non-refundable, and claims for defects discovered later can be limited by contract or law. Before hiring, ask what the due diligence report will cover, which searches are included, how long it will take and what remedies the lawyer would suggest for problems found.
