413 law firms worldwide practising Bad Faith Insurance. Narrow down by city to find a firm near you.
A bad faith insurance claim argues that an insurer broke its duty to treat its own policyholder fairly. Typical examples are a claim denied without a proper investigation, months of silence after a fire or flood, a lowball offer with no explanation, or a refusal to settle a liability claim within limits that leaves the insured exposed to a larger judgment.
The concept comes mainly from United States law, where many states allow extra damages beyond the policy amount and some allow punitive damages. Other countries handle the same problem through different tools. These include statutory interest on late payment, complaints to an insurance ombudsman, regulator sanctions or ordinary breach of contract claims. A bad faith lawyer will tell you which remedies exist where your policy was issued.
Many US bad faith firms work on contingency, taking a share of what they recover, with costs advanced by the firm. In much of Europe success fees are restricted or banned, so hourly rates, fixed fees or legal expenses insurance take their place. Limitation periods for contract claims and for bad faith claims can differ, and policies often add their own suit limitation clause. Keep every letter, email and call note from the claim.
Ask the lawyer whether your facts show bad faith or only a coverage disagreement, since the two lead to very different outcomes. Ask too how the firm funds expert reports and what happens to costs if you lose. Filter by country or city below.
